Such actions "shall not constitute a clinical investigation" [ 21 USC §360bbb–3(k) ]....and combined with Emergency Use Authorizations (EUA) make it 100% legal....or rather provides 100% immunity from suit/liability due to any losses arising et. al. from the use of a covered countermeasure [ 42 USC §247d–6d (a)(1-2) ].
In more simple terms, the EUA + pandemic declaration covered countermeasure protocol creates an unlimited legal "grey area" or "no-mans-land" where DoD contracted Pharma to produce large scale prototype demonstrations. These demo/prototype "non-pharmaceutical interventions" are allowed to be offered to the public during pandemic declaration under EUA...WITHOUT ANY CLINICAL INVESTIGATION WHATSOEVER. Vaccine vial content disclosure is not required as there is technically no investigation. And there is no "stopping" condition because....well....there's legally no product (pharmaceutical or otherwise) "investigation" to stop.
All that said, there is a silver lining here: While more people than I thought may have gotten the magic potion, the flip side is also true: LESS people took the initial jab and especially boosters than The Powers that Shouldn't Be wanted. As those pushing the shots would be incentivized to present all this non-clinical data on vaccination rates et. al in such a way that would discourage so-called 'vaccine hesitancy' (to induce nudging with Asch Experiment-style "everyone else is doing it, so you should also" psy-op)
